In light of recent news about the suspension of immigrant visas for 75 specific countries, we know there is a lot of confusion in our community. At RISE Immigration Services, we have analyzed the updates from the Department of State and the DHS to give you clarity: although surveillance is stricter, most processes for Mexico and other key partners continue, but now under much more rigorous financial solvency rules.

Why is there a "Visa Freeze" in 2026?

The U.S. government has implemented these temporary pauses based primarily on "Public Charge" criteria. This means that the consular officer must be fully convinced that the applicant has sufficient financial resources to support themselves without government assistance.

  • Countries on the list: The suspension affects 75 nations, including Brazil, Colombia, Cuba, Nicaragua, Pakistan, and Russia.

  • Situation of Mexico: Fortunately, Mexico is not on the suspension list, so immigrant visa processes continue normally.

  • Non-Immigrant Visas: It is important to note that tourist visas (B1/B2), student visas (F, M), and temporary work visas (H-1B, TN) are not suspended and can be processed as usual.


What the law says about "Public Charge"

Many wonder what allows these actions. U.S. immigration law (INA Section 212(a)(4)) allows declaring inadmissible any alien who is considered "likely to become a public charge." Therefore, the government is reevaluating review protocols to ensure that new residents do not depend on social assistance programs upon arrival.
